These Terms of Use (“Terms”) govern access to and use of the HireIndex platform, including its website, applications, tools, and services (collectively, the “Platform”).

By accessing or using HireIndex, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • “HireIndex”, “we”, “our”, “us” refer to the entity operating the Platform.
  • “User” refers to any individual or organization using the Platform.
  • “Candidate” refers to users who submit personal or professional data for evaluation.
  • “Employer” refers to companies or recruiters accessing candidate profiles or evaluations.
  • “Content” includes data, text, assessments, scores, analytics, and materials available on the Platform.

2. Nature of the Platform

HireIndex is a technology platform that provides:

  • Candidate evaluation tools
  • Talent discovery and matching features
  • Data-driven hiring insights

HireIndex is NOT:

  • An employer
  • A recruitment or staffing agency
  • A background verification service
  • A decision-maker in hiring outcomes

All hiring decisions are made solely by Employers.

3. Eligibility & Account Responsibility

You must:

  • Be at least 16 years of age
  • Provide accurate and current information
  • Maintain confidentiality of login credentials

You are responsible for all activity under your account.

HireIndex reserves the right to suspend or terminate accounts for violations.

4. Candidate Obligations

Candidates agree that:

  • All submitted information is truthful to the best of their knowledge
  • Misrepresentation may result in account suspension or score invalidation
  • HireIndex Scores are evaluative, not guarantees

Candidates acknowledge that:

  • Scores are relative, probabilistic, and context-dependent
  • Visibility to Employers is not guaranteed

HireIndex Scores are algorithmic estimates, may change over time, and should not be treated as definitive evaluations. HireIndex is not responsible for any decisions or outcomes based on these scores.

5. Employer Obligations

Employers agree that they:

  • Will use candidate data only for internal hiring purposes
  • Will not scrape, download, resell, or redistribute data
  • Will not use HireIndex data to train external models
  • Will not contact candidates outside permitted Platform channels (if restricted)

Employers may not:

  • Treat HireIndex Scores as sole decision criteria
  • Represent HireIndex as endorsing or guaranteeing a hire

Violation may result in:

  • Immediate termination
  • Loss of access
  • Legal action

5A. Acceptable Use

Users agree NOT to:

  • create fake or misleading profiles
  • attempt to reverse-engineer scoring systems
  • scrape or extract platform data
  • use bots or automation
  • misuse the platform for non-hiring purposes

6. Intellectual Property Rights

6.1 HireIndex IP

HireIndex owns all rights to:

  • Platform software
  • Algorithms
  • Scoring systems
  • Models
  • Derived analytics
  • HireIndex Scores and rankings

Nothing in these Terms transfers ownership of HireIndex IP.

6.2 User Content

Users retain ownership of:

  • Raw personal data
  • Original content they submit

Users grant HireIndex a worldwide, non-exclusive, royalty-free license to use such content for Platform operations.

7. Data Usage & Privacy

Use of the Platform is subject to the Privacy Policy, which is incorporated by reference.

If there is a conflict, these Terms prevail.

HireIndex may access basic Google account information such as email and profile details strictly for authentication purposes. HireIndex does not sell or misuse Google user data.

Users may request deletion of their account and associated data. HireIndex will process such requests within a reasonable timeframe.

8. No Guarantees or Warranties

The Platform is provided “as is” and “as available.”

HireIndex makes no warranties regarding:

  • Hiring outcomes
  • Employment offers
  • Score accuracy
  • Employer behavior
  • Platform availability

Use is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

HireIndex shall not be liable for:

  • Lost opportunities
  • Employment decisions
  • Reputational damage
  • Indirect or consequential damages

Total liability shall not exceed the amount paid to HireIndex (if any) in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold HireIndex harmless from:

  • Claims arising from your misuse of the Platform
  • Violations of these Terms
  • False or misleading information you provide
  • Employer hiring decisions

11. Suspension & Termination

HireIndex may:

  • Suspend or terminate access without notice
  • Remove content
  • Invalidate scores

Upon termination:

  • Access ceases immediately
  • Certain clauses survive termination

12. Modifications to the Platform

HireIndex may:

  • Modify or discontinue features
  • Update scoring methodologies
  • Change access levels

No obligation to maintain backward compatibility.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Courts located in Bangalore, India shall have exclusive jurisdiction.

14. Dispute Resolution

HireIndex reserves the right to:

  • Seek injunctive relief
  • Resolve disputes through arbitration where applicable

15. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and HireIndex.
